Terms of sale
These Terms and Conditions of Sale (“Terms and Conditions”) govern sales made through the Hairstealyst website, operated by:
Hairstealyst – Micro-enterprise
Address: 6 Bis avenue Louis Barthou, 35000 Rennes, France
Email: contact@hairstealyst.com
Any order placed on the website constitutes acceptance of these Terms and Conditions.
1. Products
Hairstealyst sells, in particular, human hair extensions, hair weaves, crochet extensions, and various hair care products presented on the website.
The essential characteristics of each product are specified on the relevant product page.
Photographs are intended to represent the products as accurately as possible. However, the perception of colours may vary depending on lighting conditions, the screen used, and its settings.
For curly or wavy textures, the length indicated corresponds to the hair length when stretched. The hair may therefore appear shorter when worn.
2. Prices
Prices are stated in euros (€).
The applicable price is the price displayed on the website at the time the order is confirmed.
Any applicable delivery charges are indicated before the final confirmation and payment of the order.
Hairstealyst reserves the right to change its prices at any time. Any price changes will not affect orders that have already been confirmed.
3. Orders
The customer selects the desired products and options before proceeding to checkout.
Before payment, the customer is invited to verify the information relating to their order, including the products, quantities, lengths, colours, contact details, and delivery address.
The order becomes final once payment has been confirmed, subject to any statutory rights available to the consumer, including the right of withdrawal where applicable.
An order confirmation is sent to the email address provided by the customer at the time of purchase.
4. Product Availability
Products are offered subject to availability.
In the exceptional event that a product becomes unavailable after the order has been confirmed, Hairstealyst will inform the customer as soon as possible and, depending on the circumstances, offer an alternative solution or a refund for the unavailable product.
5. Payment
Payment is made using the payment methods offered on the website at the time the order is placed.
Where payment in instalments is offered, the applicable terms are those of the relevant payment service provider and are presented to the customer during the payment process.
The order will only be processed once payment has been confirmed.
6. Order Preparation and Delivery
The order preparation time and delivery time are two separate periods.
The estimated preparation time is indicated on the website or on the relevant product page. Once the order has been prepared and dispatched, the delivery time depends in particular on the selected delivery method and destination.
The delivery times communicated to the customer at the time of the order are those applicable in accordance with the relevant legal provisions.
The customer is responsible for ensuring that the delivery address provided when placing the order is accurate and complete.
In the event of an incorrect address provided by the customer resulting, in particular, in the parcel being returned, a new shipment may require payment of additional delivery charges.
7. Receipt of the Order
Upon receipt of the order, the customer is encouraged to check the condition of the parcel and the conformity of the products received.
In the event of a missing, incorrect, damaged, or apparently defective product, the customer is invited to contact Hairstealyst as soon as possible at: contact@hairstealyst.com, providing their order number and, where useful, photographs showing the issue.
This procedure does not limit the consumer’s rights under statutory warranties.
8. Right of Withdrawal
In accordance with the French Consumer Code, consumers generally have a period of 14 days from receipt of the goods to exercise their right of withdrawal without having to provide any reason.
The customer must notify Hairstealyst of their decision to withdraw before the expiry of this period, either by using the withdrawal form made available to them or by making any other unequivocal statement expressing their decision to withdraw.
After exercising their right of withdrawal, the customer has 14 days to return the product.
Unless otherwise indicated by Hairstealyst, the direct costs of returning the product are borne by the customer.
Products must be returned with due care and must not have been handled beyond what is necessary to establish their nature, characteristics, and proper functioning.
In accordance with the exceptions provided for by the French Consumer Code, the right of withdrawal may notably not apply to goods made to the consumer’s specifications or clearly personalised, as well as to goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection, where the legal conditions for such an exception are actually met.
The mere fact that a product is a hair extension does not therefore automatically exclude it from the right of withdrawal.
9. Refunds in the Event of Withdrawal
Where the right of withdrawal is validly exercised, Hairstealyst will refund the amounts due in accordance with the applicable legal provisions.
The refund will be made no later than 14 days from the date on which Hairstealyst was informed of the customer’s decision to withdraw.
Hairstealyst may defer the refund until the goods have been recovered or until the customer has provided proof of dispatch of the goods, whichever occurs first.
The refund will be made using the same payment method as that used for the original transaction, unless the customer expressly agrees to another method.
10. Personalised Products
Where Hairstealyst offers a product made according to the customer’s specific requirements or clearly personalised, the product may be excluded from the right of withdrawal under the conditions provided for by the French Consumer Code.
Where this exception applies, the customer will be informed before the order is concluded.
11. Sale Items and Promotions
Products subject to a discount, promotion, or special commercial offer remain subject to the rights provided for by applicable legislation.
The fact that a product is discounted or on sale does not, by itself, remove the statutory right of withdrawal applicable to distance sales.
12. Statutory Warranties
Products sold by Hairstealyst are covered by the statutory warranties applicable under French law, including the statutory warranty of conformity provided for by the French Consumer Code and the warranty against hidden defects provided for by the French Civil Code.
Statutory warranties apply independently of any commercial warranty that may be offered by Hairstealyst.
13. Use and Care of Hair Extensions
The lifespan and condition of hair extensions depend, in particular, on their use and care, the products applied to them, washing frequency, the use of heat-styling tools, and any chemical treatments or colouring carried out after receipt.
Customers are advised to follow the care instructions provided on the website.
Normal changes to the product resulting from use or ordinary wear and tear do not necessarily constitute a lack of conformity.
This provision does not in any way limit the application of statutory warranties where the product actually presents a defect covered by such warranties.
14. Liability
Hairstealyst is responsible for the proper performance of its obligations under the conditions provided for by applicable legislation.
However, Hairstealyst cannot be held liable for damage resulting from improper use of the product, clearly inappropriate care, or any alteration to the product carried out after delivery, where the damage results from such intervention.
Nothing in these Terms and Conditions shall have the effect of excluding or limiting any mandatory rights granted to consumers by law.
15. Personal Data
Personal data collected when orders are placed is processed in accordance with the Privacy Policy available on the website.
